Immobiliere Genevoise - Flat rent deposit in Geneva: amount and recovery in 2026

How much can the landlord demand? The cap of 3 months' rent (art.

You are viewing a 3-room flat at CHF 2,000 per month, net rent, service charges extra. When the lease is signed, the letting agency asks you for 4 months' deposit, i.e. CHF 8,000. This demand exceeds what the law allows.
Article 257e of the Code of Obligations (CO) sets the cap at three monthly rents for a dwelling. For a rent of CHF 2,000, the rent deposit therefore cannot exceed CHF 6,000. The text is available at fedlex.admin.ch. This limit is mandatory: a lease clause that exceeds it is ineffective for the excess portion.
Two useful points. The cap is calculated on the rent, excluding ancillary charges, according to the usual reading of the text. And it applies to security provided in cash or in securities, which must be deposited with a bank, in a savings or deposit account in the tenant's name.
Geneva has a vacancy rate below 1%, as published by the Federal Statistical Office (bfs.admin.ch). In this context, a landlord may be demanding about the application file. He is not entitled to circumvent the statutory cap. If the contract provides for 4 months, request in writing a reduction to 3 months before paying anything.
In practice: note the net rent shown in the lease, multiply it by three, and compare the result with the amount requested. Any discrepancy should be corrected before payment, not afterwards.

Blocked account, bank guarantee or deposit insurance: which form?

Three forms coexist on the Geneva market.
The blocked account. You open a deposit account with a bank, in your name, and pay the sum into it. The money belongs to you and earns interest, but it remains tied up for the entire duration of the lease. For a rent of CHF 2,000, CHF 6,000 lie dormant in the account.
The bank guarantee. Your bank undertakes to pay the landlord up to the guaranteed amount, on justified request. Depending on the institution, it may be covered by a deposit or by a credit limit. The conditions vary from one bank to another.
Deposit insurance. An insurer or a specialist provider stands surety towards the landlord in return for a premium. You do not tie up any capital. In return, the premium is a sunk cost: you do not get it back on moving out. Offers exist in particular from AXA, la Mobilière, GoCaution, SmartCaution or Caution Loyer Suisse. Check their current terms, as premiums and acceptance criteria change.
The choice depends on your cash position. If you have the sum available, the blocked account costs nothing and earns a little interest. If you lack the capital, for example during a move that combines removal van costs, double rent and a deposit, deposit insurance frees up liquidity.
Please note: the landlord is not always obliged to accept deposit insurance. A rent deposit is a contract between you and him. Check the agency's agreement before taking out a policy, otherwise you risk paying a pointless premium.
Capital tied up
Blocked accountCHF 6'000 blocked for the entire duration of the lease (for a rent of CHF 2'000)
Bank guaranteeCovered by a deposit or by a credit limit, depending on the institution
Deposit insuranceNo capital blocked
Return or cost
Blocked accountInterest earned on the account
Bank guaranteeConditions vary depending on the bank
Deposit insurancePremium not recoverable on moving out
Ownership of the funds
Blocked accountThe money remains the tenant's
Bank guaranteeThe bank undertakes to pay the landlord on justified request
Deposit insurancePremium lost, a definitive cost for the tenant
Condition of acceptance
Blocked accountDeposit with a bank, in an account in the tenant's name
Bank guaranteeConditions vary from one bank to another
Deposit insuranceThe landlord is not always obliged to accept it: agency's agreement to be checked before taking out the policy
Only deposit insurance frees up your capital, but its premium is lost for good

Key takeaway

For a rent of CHF 2'000, the blocked account ties up CHF 6'000 that remain yours, whereas deposit insurance ties up nothing but costs a premium that is never recovered.

What happens in Geneva if the landlord wants to draw directly?

A bank guarantee on a blocked account remains the tenant's property: the landlord can only access it with your written consent or by court decision. This is the rule of article 257e CO, which requires the deposit to be made with a bank, in an account in the tenant's name.
In concrete terms, if the agency asks for payment into its own account, refuse. A transfer to the agency's or the owner's account deprives the tenant of the statutory protection. In the event of the landlord's bankruptcy or of a dispute, you would have to chase your money.
The bank releases the funds only in three cases:
  • both parties jointly sign the release request
  • the landlord presents a judgment or a payment order that has not been contested
  • the landlord proves that he has brought his claims before the courts within the statutory time limit
So, even if you left damage in the flat, the landlord cannot help himself unilaterally. He must obtain your signature or an enforceable title.
If the landlord threatens to terminate the lease on the grounds that you refuse direct payment, remind him in writing of the legal basis. For any dispute over the form of the security, ASLOCA (asloca.ch) advises its members and can review the contract.

How to recover your deposit when leaving the flat?

Moving out should be prepared from the inventory (check-out inspection) onwards. This document, signed by both parties, records the condition of the flat on return. Insist on a copy and note any reservation made by the landlord. Also obtain a receipt for the handover of the keys, dated and signed.
If the landlord makes no claim, the bank releases the deposit on joint request. In practice, ask the agency to co-sign the release form. Many agencies do so within the weeks following the check-out inspection.
If the landlord delays or objects, a statutory time limit protects the tenant. Once one year has passed after the return of the keys without any claim from the landlord, you can demand release of the deposit: a registered letter is sufficient. This time limit derives from article 257e, paragraph 3, CO, which allows the tenant to demand release if the landlord has not asserted his rights in court within the year.
The registered letter must state:
  • the address of the flat and the date the keys were returned
  • the number of the deposit account
  • the request to sign the release form within 10 days
  • the statement that, failing this, you will bring the matter before the Tribunal des baux et loyers (Rent and Tenancy Tribunal)
Keep the postal receipt. It proves the date of your request.
If a legitimate claim exists, for example damage not attributable to normal wear and tear, the agency may request partial release. The undisputed part must be released without delay.

What to do if the landlord refuses to release the sum? (Rent

The landlord's refusal is not final. In Geneva, the Tribunal des baux et loyers is competent for disputes concerning rent deposits. The procedure begins with an attempt at conciliation before the Commission de conciliation en matière de baux et loyers (Conciliation Commission for leases and rents), which is free of charge to the parties in most tenancy disputes.
Practical steps:
  • send a formal notice by registered letter, with a 10-day time limit
  • if there is no reply, file a request for conciliation with the competent Geneva commission
  • if conciliation fails, you receive an authorisation to proceed, and you then bring the matter before the Tribunal des baux et loyers
The bank, for its part, blocks the funds as long as no decision or agreement is produced. A landlord who wishes to keep all or part of the deposit must also take legal action within the one-year period, failing which you can obtain release of the whole amount.
Prepare a solid file: lease, move-in and move-out inventories, key handover receipt, dated photos, correspondence exchanged, deposit account statement. The tenant can be assisted by ASLOCA, and both the City of Geneva and the canton offer legal advice sessions to guide litigants (ge.ch/logement).
Stay factual in your correspondence. A clear and chronological file carries more weight than a letter of reproach.

Flatshares, subletting, condominium ownership: the special cases that

Flatshare. If several flatmates co-sign the lease, the deposit is in principle paid for the lease as a whole, with a cap of three months' rent calculated on the total rent. For a rent of CHF 3,000 shared between three, the maximum deposit is CHF 9,000, i.e. CHF 3,000 per person. The delicate issue is the departure of a flatmate: the bank is not required to return his share while the lease is running. Settle the question in writing between flatmates, and have the agreement recorded by the agency. Departing and incoming flatmates may provide for an internal reimbursement, but the account remains tied to the lease.
Subletting. The main tenant remains solely bound to the landlord. He may ask his subtenant for a deposit, but this remains a private matter between them. The same principles of caution apply: a reasonable cap, an account in the name of the person paying, a written receipt. On the framework for subletting, you will find guidance in our article on renting a flat with a lease in progress.
Condominium ownership (PPE) and owner-landlord. When the dwelling is in condominium ownership, the landlord is the co-owner who lets his unit. The rules of article 257e CO do not change: the deposit is paid into a bank in the tenant's name. If the property is sold during the lease, the lease passes to the purchaser, and the deposit follows. Check that the new purchaser does take over the security and obtain written confirmation.
For any unusual situation, consulting an ASLOCA lawyer or a specialist solicitor avoids costly mistakes. If you are still looking for a home, our guide to finding a flat in Switzerland details how to put together your application file.

How much does deposit insurance cost compared with a blocked account?

Let us take the typical case: rent of CHF 2,000, maximum deposit of CHF 6,000, 5-year lease.
Blocked account. You tie up CHF 6,000. The capital remains yours, together with the interest the bank pays on this type of account, generally modest. The real cost is that of capital not working elsewhere. On moving out, you recover everything, interest included, subject to the landlord's justified claims.
Deposit insurance. You tie up nothing. You pay a premium, most often annual, the amount of which depends on the insurer and the sum guaranteed. This premium is not refunded. Over 5 years, it adds up: it is the price of the liquidity retained. The exact amounts appear on the providers' websites (gocaution.ch, axa.ch, mobiliere.ch, cautionloyersuisse.ch, smartcaution.ch). Ask for a quotation for your rent and expected duration, as the scales change.
How to weigh it up:
  • long lease and available savings: the blocked account costs almost nothing and the sum comes back
  • short lease or tight cash position: the premium may be justified to keep liquidity
  • in all cases, check that the landlord accepts the chosen form before taking out a policy
A simple rule: add up the premiums over the expected duration of the lease, and compare them with the return you would earn on the CHF 6,000 if it remained available. If the total of the premiums far exceeds this return, the blocked account remains the most economical solution for anyone who has the capital.

The 3 reflexes before paying anything

Three steps sum up the essentials.
First reflex: the cap. Three monthly rents at most (art. 257e CO), i.e. CHF 6,000 for a rent of CHF 2,000. Any higher demand should be challenged in writing before signing.
Second reflex: the account in the tenant's name. The money is deposited with a bank, in a deposit account in your name. Never into the agency's or the owner's account.
Third reflex: the key handover receipt. Together with the signed check-out inspection, it dates the start of the one-year period that protects your right to recover the deposit.
Before signing, have your lease and the deposit clause reviewed by ASLOCA or by a tenancy law professional. A review before payment costs less than a dispute after moving out.

FAQ

The statutory cap is three monthly rents, under article 257e of the Code of Obligations. For a net rent of CHF 2,000, the deposit cannot exceed CHF 6,000. Any clause fixing a higher amount is ineffective for the excess.

No. A cash rent deposit must be paid into a bank, in a savings or deposit account in the tenant's name. The landlord can only access it with your written consent or on the basis of a court decision.

If the landlord has not asserted any claim in court within the year following the end of the lease, you can demand release of the deposit from the bank. A registered letter sent to the agency helps document your request.

It can replace it if the landlord accepts it. You do not tie up capital, but the premium paid is not refunded on moving out. Check the agency's agreement before taking out a policy, as the deposit remains a contract between tenant and landlord.

Send a formal notice by registered letter, then apply to the Commission de conciliation en matière de baux et loyers and, if necessary, to the Tribunal des baux et loyers. Gather the lease, the inventories, the key handover receipt and the correspondence.
